Breach of confidence is the newest of the privacy torts, most commonly applied in a medical setting. Why might jurisdictions have been more reluctant to recognize such a claim? Some scholars see untapped potential in a breach of confidence claim outside the medical setting—for example, in cases involving revenge porn.
