Part VII. Hedge Funds and Multiple Gatekeepers: TFR Class Sixteen: April 6, 2015
In today's class, we will take up the subject of hedge funds and use that topic to explore the role of gatekeepers in financial regulation. Our first reading is a Harvard Law Review case comment involving a failed attempt on the part of the SEC to regulate hedge fund advisers before the Financial Crisis of 2008. The second reading is a decision from litigation arising out of investments made through "feeder funds" with Bernard L. Madoff Investment Securities. Relevant to our consideration of the decision is Andrew Tuch's article on Multiple Gatekeepers.
