Federal Budget Policy (Spring 2015)

Class Seventeen: Thursday, April 9, 2015

For today's class, we will continue our consideration of the spending powers of the judiciary. There are two readings on this topic.  First, we will be Richard Briffault's chapter from Fiscal Challenges dealing with State challenges of budgeting requirements. Then we will look at a pair of well-known Supreme Court case on the federal judiciary's spending power. Focus first on Jenkins II, and then -- as time permits -- skim Jenkins III to get a sense of how the Supreme Court's position evolved later in the litigation.  The student presentation will be Patrick's paper on the Gold Cases, which will be posted on Tuesday, April 7th.
