1. As you will see, the formula used by the Voting Rights Act to determine which jurisdictions are subject to preclearance is underinclusive and overinclusive if different metrics are used. Consider which metrics you think are valid. Consider whether the metrics Congress did in fact employ (and that were struck down in Shelby County) were sufficiently bad to deserve that fate.
