Judge Rakoff’s resignation letter
As you know, the now disbanded National Commission on Forensic Science was formed in response to the 2009 NRC Report and was charged with adopting recommendations for the Department of Justice.
One of the Commission members was Judge Rakoff. At one point, Judge Rakoff abruptly resigned from the commission because of the position the government adopted regarding discovery. (He later rejoined after DOJ reversed its position.)
This is the full text of Judge Rakoff’s letter; note the emphasis he places on the relationship between discovery and scrutinizing forensic science.
