Freedom of Religion: Challenges

In this unit, we will deepen our understanding of the religious-based arguments raised in the battles over sex, sexuality, gender identity, and reproduction. These claims arise both in the constitutional context and under the Religious Freedom Restoration Act, 2 U.S.C. ยง 2000bb et seq., which provides more expansive at the time of this writing than the comparable constitutional standard. We will focus on the dynamism and unpredictability of this area of law--one that the current Court seems intent on transforming.
